The Statement of Rehabilitation Centre for Victims of Torture “Empathy” about the case of Archil Tatunashvili

 As it’s well-known to the public, citizen of Georgia Archil Tatunashvili was killed in February 23, 2018 in city Tskhinvali. The occupational and de-facto regimens hadn’t conveyed the corpse during one month with the motive of so called expertise.

From the 26th of February of this year, with consent of his family, the Legal and Expertise Departments of the Centre “Empathy” were involved in the mentioned case. The Centre “Empathy” offered the family to file a complaint to the European Court of Human Rights with demand of using 39th Rule, what means an urgent measure, but consent from the family regarding mentioned issue wasn’t received.

On the 20th of March the corpse was handed over to Georgia with insufficient material for expertise, what served as an attempt of hindering of identifying the reason of death and providing a comprehensive expertise.

The Expert of the Centre “Empathy” took part in expertise on the 20th of March. Later we learned, that without the agreement with the Legal Department of the Centre “Empathy”, the other lawyer was protecting interests of the family, consequently, the Centre “Empathy”, according to its strategic interests, continues participation in the expertise only on the basis of the investigator’s decree, what doesn’t mean an involvement from the side of party and advocacy services, unfortunately, this is a hindering factor for preparation of comprehensive expertise conclusion.

On the 12th of April the Centre “Empathy” appealed in writing to the Forensic Medicine Department of Levan Samkharauli National Forensics Bureau and on the basis of Article 52 of Criminal Procedural Code of Georgia, requested materials for preparation of conclusion, as well as notified investigation regarding this.

In case of obtaining needful materials for expertise, the expert of the Centre “Empathy” will present separate provisional conclusion in a week, with indications of recommendations for further actions.
